|Go Skye! Terms & Conditions|
|Acceptance of the Terms & Conditions detailed below is implied when a booking is made.|
|Bookings||Bookings may only be made online or through an appointed agent. You cannot pay the driver. All seats must be booked in advance. Your seat reservation will only be confirmed when full payment is received by Go Skye! or an appointed agent and confirmed either by electronic means or by the printing of a ticket. All bookings on the services are shared, by booking you accept that you are sharing the vehicle. We do not offer concessionary fares on any of our services. Fares shown are one way and per person.|
|Departure point||All tours / shuttles depart from Portree next to the Visit Scotland Information Office which is located in Bayfield Road, Portree.|
|Personal Possessions||Each client is responsible for loss of or damage to baggage or personal possessions or consequential loss arising there from. In the event of client illness or client injury then the client must accept responsibility for any medical costs incurred and Go Skye! shall not be liable to refund any part of the ticket cost.|
|Bicycles||We will carry bicycles on our buses with the following restrictions. Bicycles will only be carried in the luggage compartment of the minibus and if the front wheel is removed. They may not be carried in the passenger compartment under any circumstances. The maximum number of bicycles we will carry will be three and the decision whether to carry bicycles rests solely with the driver. The carriage of bicycles is at our discretion at all times and is not an obligation on our part. All bicycles are carried entirely at your own risk and you accept this prior to our transport of them.|
|Health & Safety||Passengers must at all times abide by the directions of the driver. You must not speak to the driver or obstruct his vision when the vehicle is moving except in an emergency. At all other times wait until the vehicle is stationary and parked.
Go Skye! reserves the right to terminate a tour if, in the opinion of the company the behaviour of a client or client group is, or is likely to be disruptive, dangerous or upsetting to other people or if such client or group have caused or are likely to cause damage to property. Go Skye! will not pay any refund or costs incurred by a client in the event that a tour or shuttle is terminated due to unacceptable behaviour.
No smoking in any of our vehicles.
|Age Policy||The minimum age for our tours and shuttle buses is 3 years old.|
|Pets||We are sorry, but we do not allow pets in our vehicles. This is in the interest of other hirers who may have allergies to animals. This is with the exception of registered guide dogs.|
|Vehicles||We reserve the right to change the type of bus used if the circumstances dictate this is necessary|
|Alterations to tours / timetables||We reserve the right to change shuttle timetables or tour itineraries due to weather, availability of attractions, roadworks, operational reasons or any other situation beyond our control. Transfer to a future date or alternative shuttle will be offered if possible. In the event of the service being unavailable to you due to the shuttle / tour being fully booked or otherwise, we shall not be liable for any costs, losses, damage or inconvenience that you suffer as a result.|
|Cancellation Policy||Shuttle Buses: No refunds are offered if you are late for a shuttle, cannot find the pick-up point or decide not to catch a shuttle you have already booked for any reason. Please be there 15 mins before the advertised departure time, our buses will not wait for late arrivals.
Scheduled Tours: A cancellation more than 21 days before tour departure – 100% refund, less administration fees of £5.00 per person. A cancellation less than 21 days before the tour date no refunds.
Private Tours: A cancellation more than 21 days prior to tour full refund, 21 to 7 days 50% refund, 7 days or less no refund (including cruise ship passengers).
Cruise Ship Tours: A cancellation more than 21 days before tour departure – 100% refund, less administration fees of £5.00 per person. A cancellation less than 21 days before the tour date no refunds. Due to the special nature of cruise ship tours, in the event of your ship being unable to berth at Portree by reason of weather conditions or other operational issues, we will issue a refund of your ticket price less a deduction of £5.00 per person to cover our card processing and administration costs. We will issue the refund providing you give us at least 24 hours notice of the ship not being able to land passengers. This policy only applies to our special cruise ship tours and not our scheduled tours.
Winter Tours: As we are running tours in the winter, on the rare occasions on the Isle of Skye when the roads are made impassable by snow, we will of course refund your booking price in full.
|Prices||All prices are shown at the checkout are inclusive of VAT (Value Added Tax). Community donations are not taxable.|
|Personal Data||How we use your Personal Information (Data Protection)
In so far as any services involve us in collecting, using, or holding or otherwise processing any Data obtained from your which is personal data (including, but not limited to, your name and address), we shall only do so with your express consent and in accordance with any lawful instructions reasonably given by your from time to time, and the provisions of the Data Protection Act 1998 and your rights under that Act and these Terms and Conditions;
We may use your personal information as follows:
1. to provide our services to you;
2. to process your payment for the services;
We will not pass on your personal information to any other third parties without first obtaining your express permission with the exception of a legitimate request by an authorised body.
|Changes to Terms & Conditions||We may from time to time change these Terms and Conditions without giving you notice, but we will use our reasonable endeavours to inform you as soon as is reasonably possible of any such change.|
|Complaints||All complaints should be initially directed to your driver who will make every effort to resolve the problem.
In the event that a complaint cannot be resolved on the day of the tour then it should be made in writing to Go Skye! c/o Highland Motors Ltd., Borve, Isle of Skye, IV51 9PE.
|No Waiver||No failure or delay by us or you in exercising any rights under these Terms and Conditions means that we or you have waived that right, and no waiver by us or you of a breach of any provision of these Terms and Conditions means that we or you will waive any subsequent breach of the same or any other provision.|
|Law and Jurisdiction||These Terms and Conditions and the relationship between you and us (whether contractual or otherwise) shall be governed by, and construed in accordance with Scottish Law; and
Any dispute, controversy, proceedings or claim between you and us relating to these Terms and Conditions (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
